ONKASAN ELEKTRONIK SANAYI VE TICARET LIMITED SIRKETI
TERMS OF USE AGREEMENT
This Terms of Use Agreement (“Agreement”) determines the rules of use, limits, and legal responsibilities of the parties for the smart home and industrial automation (Garden Irrigation, Lighting, etc.) devices manufactured by Onkasan Elektronik Sanayi ve Ticaret Limited Sirketi (“Onkasan” or “Company”), the web panel where these devices are managed, and the mobile application (“System”).
Any individual or institution (“User”) using our systems (mobile application, web panel, and devices) is deemed to have read, understood, and accepted the conditions below.
1. ACCOUNT SECURITY AND PASSWORD RESPONSIBILITY
Users are responsible for the cyber and physical security of their accounts through which they access the system:
- Default Password Obligation: Users are obliged to change the default password specified in the user manual upon their first entry into the web panel interface or the system via the local network after the installation of the device.
- Disclaimer: Our Company can definitely not be held responsible for unauthorized access, data leaks, or operation of the device in undesirable ways that may occur due to not changing the default password, choosing weak passwords, or sharing the password with third parties.
2. NETWORK AND CONNECTION CONDITIONS
There are certain technical infrastructure requirements for our automation devices to work stably and smoothly over the internet or local network:
- 2.4 GHz WiFi Requirement: Our devices standardly support only the 2.4 GHz WiFi network frequency. 5 GHz network connections are not supported by the hardware, and the device cannot see these networks. The User must ensure that the 2.4 GHz broadcast is active on their router (modem).
- Connection Quality: Our Company cannot be held responsible in cases where the system does not respond or commands are executed with delay due to the physical distance of the device from the modem, signal blockers (thick walls, etc.), instantaneous disconnections caused by the internet service provider, high ping (delay) times, or regional power cuts.
3. SINGLE CONTROL SESSION
In order to ensure the safety of the device hardware and prevent logical conflicts created by different commands (turn on/off) that can be sent at the same time, the Single Control Session architecture is applied in our system:
- Working Principle: During the moments when the devices are operated in local control (local network) mode, only a single mobile application (client) can connect at the same time to send commands.
- Busy Warning: If a second user or device tries to establish a connection while a user is controlling the device, the system gives a "busy" warning and temporarily restricts this access. This is not a software or hardware bug, but a deliberate security standard designed to ensure end-to-end security and system stability.
4. UNAUTHORIZED INTERVENTION AND OUT-OF-WARRANTY CONDITIONS
It is essential to preserve the hardware and software integrity of the devices manufactured by Onkasan. In the event of detection of any of the following actions, the device is immediately excluded from the scope of warranty, and all kinds of technical, financial, and legal responsibilities that may arise belong entirely to the User:
- Unauthorized and physical intervention in the closed enclosure (box) of the device,
- Replacement of electronic circuits, relays, or other hardware components, or engaging in reverse engineering activities,
- Deleting, modifying, cracking the original Onkasan firmware (software) codes inside the device, or attempting to load unofficial third-party software onto the device.
5. LIMITATION OF LIABILITY (DISCLAIMERS)
The System (software, hardware, web panel, and mobile application) is provided "as is" and "as available" to the extent permitted by applicable laws.
Onkasan Elektronik cannot be held responsible for material or moral damages, data losses, or interruption of irrigation or lighting activities resulting from the following situations:
- Incorrect or incomplete physical/electrical installation of the device contrary to the user manual,
- Damages occurring in the device or its connected terminal units due to fluctuations in network electricity, high voltage, or installation errors,
- Unauthorized hardware interventions by the user,
- Failure of automation commands (e.g., scheduled garden irrigation) to run on time due to regional electricity or internet cuts occurring involuntarily or due to force majeure.
6. INTELLECTUAL PROPERTY RIGHTS
All codes, designs, logos, and texts in all Onkasan products, including the application, website, device interfaces, and embedded software (firmware) within the hardware, are the intellectual property of our Company. They cannot be copied, reproduced, or used for commercial purposes without permission.
7. RESOLUTION OF DISPUTES
These Terms of Use are subject to the laws of the Republic of Turkey. Ankara Courts and Enforcement Offices are exclusively authorized for the resolution of any disputes that may arise from the application or interpretation of the Agreement.
